KENT – The developer of hundreds of planned townhomes in Kent will receive $1.5 million and up to 16 years of tax abatements as part of its legal settlement with the town over the project’s construction delays.

The Town Board last month approved settling the Kent Manor case. Details of the damages remained under a gag order imposed by state Supreme Court Justice Andrew O’Rourke until last week. A copy of the settlement agreement was filed Friday in the Putnam County Clerk’s office.

“I think the Town Board is relieved to have this case behind us. Now we can move forward with the town’s business,” Supervisor Kathy Doherty said today.

The town’s insurance carrier will pay $1.25 million and the remainder of the cash judgement will come from the town’s coffers.

Kent Manor was settled out of court last week and the results of that will be known today. I’m guessing it was an amicable settlement. Judge O’Rourke warned the parties, once again, not to talk about anything to anyone about anything until details of the settlement are released this morning. According to news reports the Town board issued a statement that said in part,

“The board collectively felt it was in the town’s best interests to put an end to a case which has dragged on for 20 years and has spanned over five town administrations. The board took proactive action, exercised due diligence and negotiated a resolution which ends the case and limits any financial exposure to the town’s citizens,” Regardless, the deeper issues about Kent Manor remain hidden: how could they go all those years without paying property taxes and how is it that the DEP/DEC would ever grant approvals for a development that is a clear insult to the watershed. DEP’s response to questions on the FEIS were akin to saying, “Yeah, Water. Whatever.”

At the very least this settlement may remove Kent Manor from being an issue during the campaign this [...]

KENT – The Town Board this week approved settling the Kent Manor case, ending years of litigation over whether a developer can build hundreds of townhomes and how much the town should pay for delaying the project’s construction.

Details, including how much money Kent will give the developers, won’t be made public until state Supreme Court Justice Andrew O’Rourke signs off on the settlement, the town’s lawyers said yesterday. On Monday, O’Rourke warned both sides he would find them in contempt of court should they discuss the matter outside his courtroom.

The damages stemmed from Kent not allowing the townhome project to proceed, even after several court decisions over the years said otherwise. Lawyers for the developers had vowed to seek millions because of expenses incurred during that time, including the elimination of some units because of new wetlands laws, the reopening of the environmental review process and missing out on the real estate [...]

KENT – Residents and town officials soon will find out how much money Kent will have to pay to developers for delaying the construction of hundreds of townhomes known as Kent Manor.

Lawyers representing the town and the developers, including RFB LLC, Kent Acres Development Ltd. and Lexington Development Corp., are due Tuesday in front of state Supreme Court Justice Andrew O’Rourke in Carmel. Basically, the only questions remaining unanswered after years of litigation are how much liability Kent faces and whether the dollar amount will be decided by just the judge or a jury.

It’s the specter of damages that worries Cliff Narbey, a resident who has followed the legal saga.

“I am very concerned that this case will cost the taxpayers of Kent a lot more money than it already has,” Narbey said. “The town has already spent a considerable sum in legal fees and [...]

Kent Manor/Pulte Homes

A special edition!

Yes folks, the developers who run this county have crossed a line from which there is no return and government is not helping. In fact, they’re assisting. Two stories….

First: Kent Manor.

Yesterday we reported that the County Legislature has worked out some sort of deal with the owners at Kent Manor which places the entirety of the blame for anything that happens/happened/might happen or might be caused to happen on the Town of Kent, and on down to the seventh generation.

What the Journal News did not report yesterday was that Kent’s primary rep to the County Legislature was not at the meeting when they took this dramatic and irresponsible action and that Mary Ellen O’dell who represents a tiny portion of that town voted no. The potential liability to taxpayers in the Carmel school district could now reach $1.7 million dollars and the financial liability to Kent could surpass $600,000, thanks to the county’s actions. These dollars are, as best I can figure, are the back taxes owed by the developer and paid by the county to the school district and to the town.

Kent Manor’s Army Corps of Engineers Wetlands Application

The owners of Kent Manor have applied to the Army Corps of Engineers for permission to fill in some wetlands. The documentation for that is here. You have until April 17, 2009 to submit your comments (in writing) to the corps. We can stop this thing.
