    At the Philipstown Town Board meeting of October 4, many Philipstown residents turned out to express their views about paving East Mountain Road North, and the way the Board is going about their decision-making. Richard Szypula presented the Board with a petition signed by 64% of the residents of that road expressing their preference for dirt over asphalt. Numerous residents voiced this preference and their concern about the lack of notice and lack of citizen input in the decision, as well as varied reasons they oppose paving this road in its entirety. Other residents were emphatic that they want the road paved. The Town Supervisor and Board members seemed unmoved and stated that their plan was to go ahead with the paving, and would not consider alternatives (like paving just the steep portions). A negative environmental impact declaration and bonding resolution were delayed on advice of Town's counsel pending a state DEC permit of some sort.

Subsequently two residents joined by the Philipstown Dirt Road Association (PDRA) filed suit against Philipstown in State Supreme Court to halt the paving. An agreement was reached between the parties in court to suspend any paving until at least November 15, when the case is scheduled to be heart by Justice S. Barrett Hickman in Carmel. Since many asphalt plants close for the season in mid-November, this may mean that paving would be delayed at least until spring.
